Maui Photographers and the Law

Maui Photographers

A friend of mine had an engagement and wedding photographer shoot on Oahu a few weeks ago and when she came home she found that her attorney had set it up on the island. He had set everything up with the website, the photographer and her real estate agent. Now, he claims he has done everything correctly but our friend still feels that something is wrong.

Well, back to the story. About a month ago she and her husband-to-be went to a Kauai hotel for their engagement photo session. The website had said they would have a couple of photographers to photograph her groom on the beach during their visit there. That is okay by most people but since our friend is from Kauai she specifically remembered the website. So, after the wedding photographer had left, our friend asked him what type of photos they would have been posting. His answer was that they were going to be posting pictures from their Kauai wedding photographer, not his personal photographer.

Okay, so, maybe the point about the website is not being able to see the photos after you pay the fee. However, let’s say that you actually could see the photos? What if that wasn’t all that was happening? For instance, what if her real estate agent had set up the website and then hired a Kauai wedding photographer to do the actual photography? If you take a close look at the entire situation, you will see that my friend ended up with two different photographers and a whole new set of fees because her real estate attorney flipped through the website and didn’t just get her one photographer.

Now then, back to my friend’s story. One of the photographers ended up sending several photos to the Kauai wedding photographer’s wife who was having her vacation at the Angkor River. In one of those photos, there was a very clear and vivid image of what appeared to be a head or neck injury. And there was another photo that showed the location in the lower portion of the river where the accident occurred. Her Angkor river vacation reservations had been booked with an Angkor riverboat tour company and she was planning to take that cruise along with her spouse.

A few weeks later, a friend who works for the same company saw one of the photos on the internet and called the number on the photo. Within a matter of seconds, he had his answer. This particular Angkor riverfront hotel was a defendant in a lawsuit that was being handled by a personal injury attorney in San Diego. And that’s when he informed his client that they were both victims in this tragic accident.

So the question is “What did the Angkor Riverfront hotel do wrong?” It seems that this particular Angkor riverfront hotel may have been careless in failing to make their guest’s personal injury claim as soon as the accident occurred. The personal injury lawyer who was handling their case failed to file it within a certain time period after the accident. Had the Angkor hotel made that promise to their guests as part of their booking process, perhaps that Angkor photographers may have had a much better chance of getting paid! Please consider all this.
